Terms, Transfer, Cancellation Policy and Conditions
Waiver of and Limitation of Liability
1. Registration Agreement and Liability Waiver
a. Register and/or agent, you represent and warrant Safety First Health that you have full legal authority to complete the class registration on behalf of yourself and or any party you are registering, including full authority to make use of the check, credit and/or debit card to which registration fees will be charged.
b. Should you be registering a minor or child under the age of 18 and or an incapacitated adult, you agree and warrant that you are the parent and/or legal guardian of the minor and/or incapacitated adult with the right and legal authority to enter into this agreement on their behalf by registration of said individual.
2. Indemnification
a. You agree and voluntarily release and hold harmless Safety First Health, its agents, officers, instructors, subcontractors and employees from any and all forms of liabilities, penalties, claims, causes of action brought by yourself and/or third parties.
b. This indemnification shall survive your termination of or cessation of use of the services and our website.
c. You agree that this indemnification clause will apply to the full extent in indemnifying American Red Cross and all parties involved with the American Red Cross association.
3. Governing Law
a. You voluntary agree that the Jurisdiction of this agreement shall be in King County in the State of Washington.
b. This agreement is personal to you and you may not assign its rights to anyone else.
c. Should a dispute arise between parties it is to be held in binding arbitration in King County in the State of Washington.
d. Should any dispute arise Safely First Health reserves the right to have the plaintiff secure at legal bond in effort to avoid bad faith litigation.
e. Registrant voluntary agree to not seek any damages and/or penalties beyond the total amount paid to Safety First Health and/or subcontractors and/or instructors and/or staff in any capacity.
4. Limitation of Use and License
a. Safety First Health grants you a personal, non-exclusive and non-transferable right to download course material.
b. You voluntary agree not to post any content and/or images from our website to webblogs, mail lists, news platforms or any electronic posting service without written consent from Safety First Health.
5. Cancellation Policy
a. Any cancellation 7 full calendar days before the class begins and registrant may receive a full refund.
b. A 25-dollar cancellation fee will be charged if cancelation is less than a full 7 days but more than 48 hours before class begins.
c. A 50-dollar cancellation fee will be charged if the cancelation is less that 48 hours before class but more than 24 hours before class starts.
d. No refund is issued if a cancelation is less than 24 hours before the start of class.
e. Cancelations may only be made in writing to safetyfirsthealth@gmail.com and it is the participant’s responsibility to check and make sure the email was received. After a cancelation is received a confirmation email will go out from Safety First Health to the payer.
f. The cancelation email will be used as the time stamp for issuing refunds.
6. Transfer Fee
a. There is a 20-dollar fee to transfer from one date to another.
b. All transfers must be done at least 72 hours before class starts.
c. All transfers must be in writing to safetyfirsthealth@gmail.com the written request will be used as a time stamp.
7. No Show Policy
a. If the registrant is a no show, no refund will be issued.
8. Visitor Policy
a. Only registered class participants are allowed in the classroom during training. Minors are only allowed if they are registered for the course being given.
9. Certification Notice
a. Certifications can take up to 3 business days to process from American Red Cross.
b. A 20-dollar fee will be charged if a class participant requires for the card be provided in under 48 hours.
10. Notice to All Attendees
a. Safety First Health reserves the right to cancel a class for any reason to include but not limited to, class too small, scheduled instructor unable to attend and/or acts of God (weather).
b. Should a class be canceled for any reason the participants will receive a full refund without penalty and/or participant may reschedule at no additional charge.
